Terms and Conditions of Sale

Preamble

These General Terms and Conditions of Sale (GTCS) exclusively govern sales made on the website https://www.exel-motor.com by the company RIVIERA RACING, to the capital of 7 622,45 €, registered in RCS of Nice under number 402 086 102.

Article 1 – Price

• 1.1 The prices of the products are indicated in euros, including VAT, excluding handling and shipping costs.
• 1.2 All orders, regardless of their origin, are payable in euros.
• 1.3 For any order placed outside mainland France, the customer is deemed to be the importer of the product(s). Customs duties, local taxes and import duties are payable by the customer.
• 1.4 RIVIERA RACING reserves the right to change its prices at any time. Products are billed at the rate in effect at the time the order is registered.
• 1.5 The goods remain the property of RIVIERA RACING until full payment has been received.

Article 2 – Order

• 2.1 The customer declares that they have the legal capacity to enter into a contract.
• 2.2 Any order constitutes acceptance of the prices and descriptions of the products.
• 2.3 To place an order, you must create or log in to a customer account (surname, first name, email address, telephone number, delivery address).
• 2.4 RIVIERA RACING cannot be held liable for customer input errors and their consequences (delays, delivery errors, reshipment).
• 2.5 The order is definitively registered after payment validation, acceptance of the General Terms and Conditions, and verification of the contact details.
• 2.6 An order confirmation is sent by email.
• 2.7 RIVIERA RACING reserves the right to refuse/cancel any order in the event of a previous payment dispute.

Article 3 – Validation

Order validation constitutes acceptance of these T&Cs. Unless proven otherwise, data recorded by RIVIERA RACING constitutes proof of the transactions concluded with the customer.

Article 4 – Availability

• 4.1 The site is not intended for the sale of significant quantities; RIVIERA RACING reserves the right to refuse orders of the same product from 5 units upwards.
• 4.2 Offers are valid as long as they are visible on the website and while stocks last.
• 4.3 If an item is unavailable after an order has been placed, the customer will be notified by email or post and offered a new delivery date, a replacement product, or a cancellation and refund.
• 4.4 Reimbursement will be made no later than 14 days from the payment of sums paid.

Article 5 – Delivery

• 5.1 Products shall be delivered to the address specified by the customer when placing the order.
• 5.2 Orders are processed within a maximum of 4 working days, excluding carrier delivery times.
• 5.3 Estimated Colissimo delivery time: Up to 72 hours.
• 5.4 The customer must check the condition of the parcel upon receipt. In case of damage, precise handwritten reservations must be recorded and signed by the delivery person.
• 5.5 In the event of a justified refusal of a damaged parcel, a new shipment will be made at the expense of RIVIERA RACING after the parcel has been returned.
• 5.6 Postage and packing are payable on order. As an indication, the charge for Europe, Corsica and Monaco is €15.
• 5.7 No deliveries will be made to DOM-TOM and countries outside the European Union.

Article 6 – Payment

• 6.1 An order is considered settled after full shipment and complete payment of products and postage.
• 6.2 RIVIERA RACING may refuse to fulfil an order in the event of total/partial non-payment of a previous order.
• 6.3 RIVIERA RACING retains ownership of the products until full payment of sums due (including fees and taxes) has been received.
• 6.4 The risks are transferred to the customer upon receipt of the goods.
• 6.5 Payment transactions are secure.

Article 7 – Right of Withdrawal (Money-back guarantee)

• 7.1 In accordance with current legislation, the customer has a period of 14 days from receipt to exercise their right of withdrawal without reason or penalty.
• 7.2 Returns must be despatched to the head office address stated in the Preamble.
• 7.3 Goods must be returned complete, unused, in perfect condition and in their original packaging.
• 7.4 Incomplete, used, damaged or unpackaged products will neither be accepted for return, nor exchanged, nor refunded.
• 7.5 Refunds are processed upon receipt and inspection of returned goods.
• 7.6 Unopened/Undelivered/Refused parcels: refund of the product and initial postage costs.
• 7.7 Voluntary return within the legal withdrawal period: refund of returned product.

Article 8 – Product Conformity

RIVIERA RACING undertakes to exchange any defective product or any product that does not conform to the order. The customer must report the problem in detail in writing and return the product concerned.

• The request must be made within 8 working days of delivery.
• Any claim submitted out of time may be refused.
• Return costs are refunded based on the standard postage rate.
• The customer also benefits from the legal guarantees (conformity and hidden defects).

Article 9 – Reimbursement

The refunds referred to in Articles 7 and 8 shall be made within 14 days or less of receipt of the returned products.

Refunds are made using the payment method used for the order, unless otherwise expressly agreed.

Article 11 – Liability

The photos and illustrations shown on the website are for illustrative purposes only. The customer is invited to refer to the description of each product.

In the event of a hyperlink to another site, RIVIERA RACING cannot be held responsible for the content of said third-party site.

Article 12 – Personal Data

The data collected is necessary for processing orders and customer relations. It is processed in accordance with applicable data protection regulations.

Article 13 – Governing Law and Disputes

These General Terms and Conditions are subject to French law and are written in French.

In the event of a dispute, an amicable solution will be sought as a priority within one month of notification. Should no agreement be reached, the dispute will be brought before the competent courts of the department of Alpes-Maritimes (Provence-Alpes-Côte d’Azur region), subject to overriding provisions applicable to the consumer.
